This Privacy Policy governs the manner in which Helium Systems Inc. and its affiliates ("Helium", "our", "we" or "us" ) collect and use personal information collected from users via (the "Site") and in connection with all products and services offered by Helium. Helium Systems Inc., and its affiliate, Helium GmbH c/o betahaus, are the controllers of your personal information.

This Policy does not apply to products or services offered by other companies, individuals or business partners, or to information that you provide to or that is collected by third parties using our technologies. The Sites contain links to other websites for which Helium is not responsible. These third parties may have their own privacy policies, which we encourage you to read before providing information to them.

  • What personal information we collect from you, how it is used and with whom it may be shared.

Personal information we collect

We may collect personal information from you in a variety of ways, including, but not limited to, when users visit our Site, register on the Site, or place an order.

Information you provide to us: We collect the personal information that you provide to us including in the following scenarios:

  • Contact information – when you email us under the ‘Get In Touch’ heading on the Site we will collect your name and email address together with any other information you provide.
  • Hotspot Interest Form – when you fill out a Hotspot Interest Form we collect your name, email address, company name and address.
  • Helium Insider information – when you register to become a Helium Insider we collect your name, email address, home address, current job title and any other information you provide.
  • Helium Patron information – when you register to become a Helium Patron we collect your name, company email address, city and state.
  • Helium for Business information – when you submit information about your business we collect your name, company name, company email, phone number and country.
  • Helium chat box information – when you use the chat box feature on our Site we collect your name, email address and any other information you provide.
  • Helium Evaluation Kit information –when you request a Helium Evaluation Kit we collect your name, company email address, city and state.
  • Order information – when you purchase products or items from us: we collect  your name, shipping and billing address and financial information like credit card number and expiration date.
  • Surveys & other communications - from time-to-time our Site may request information about your experience with Helium and/or our products or services. Participation in the surveys is completely voluntary, and you may choose whether or not to participate and therefore disclose any personal information requested. Personal information requested may include name and contact information and demographic information (such as zip code, age level). Contact information collected via surveys may be used to market to you about third party products and services where we have obtained your prior explicit consent.

Automatic data collection: When you browse or use our Sites, we and our third party service providers collect information about the services you use, other websites you've visited and personal preferences. This information includes: device-specific information (such as your operating system, mobile phone network, mobile device ID, and other device-specific unique device identifiers such as your computer's internet protocol (IP) address), user information, specific geographical location and browsing and interaction habits.

Consequences of not providing your personal information

Where we require your personal information to comply our legal or contractual requirements, failure to provide this information means we may not be able to process your order and/or provide services to you. We will tell you when we ask for your personal information whether it is a statutory or contractual requirement to give us the personal information and the consequences of not providing such personal information.

Recipients of your personal information

We may share personal information within the Helium to allow us to provide our goods and services to you. We may also share your personal information with the following third parties:

  • Service providers: We may share your personal information with third party service providers who provide us with services, including companies that provide us with technical support, hosting services, customer relationship management, and assistance and order and payment processing providers.
  • To enforce our rights: The servers used in the operation of the Sites automatically identify a computer by its IP address.  If we, in good faith, determine that you have or are attempting to misuse or harm the Sites, we may investigate and cooperate with appropriate law enforcement agencies to protect our rights or property. We may disclose your personal information  to enforce our rights arising from any contracts entered into between you and us, including the Terms & Conditions.
  • In response to legal process: We may share your personal information  as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to advisers, law enforcement agencies, judicial and regulatory authorities.
  • Business transfers: To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Helium’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information  held by Helium is among the assets transferred.
  • Social media: We have a presence on various social media platforms, such as Facebook, Twitter, LinkedIn and YouTube. We may share your personal information with these platforms for them to provide us with anonymized and aggregated demographic and use information, including page impressions, “Likes,” traffic links and page views, which we use to improve our marketing efforts.


Your rights and choices

You may log into Helium to review and update your registration information. You may also delete your account at any time. Most data requests on your registration page will be updated automatically.

You also have the following rights in relation to your personal information:

  • request access to personal information we hold about you;
  • the correction of your personal information when incorrect, out of date or incomplete;
  • request that we erase your personal information;
  • opt-out of any marketing communications that we may send you and to object to us using/ holding your personal information if we have no legitimate reason to do so;
  • request that we restrict the processing of your personal information (i.e., we would need to secure and retain the data for your benefit but not otherwise use it); 
  • withdraw your consent at any time (e.g., for direct marketing); and
  • the portability of your personal information  (i.e., ask for a copy of your personal information to be provided to you, or a third party, in a digital format).

We will respond to your request in writing, or orally if requested, as soon as practicable and in any event not more than within one month after receipt of your request. In exceptional cases, we may extend this period by two months and provide you with reasons. We may request proof of identification to verify your request. How we protect your personal information

We adopt reasonable and appropriate  technical and organizational measures to secure and protect against unauthorized access, alteration, disclosure or destruction of your personal information.

While we use security measures to protect sensitive and personal information transmitted online, please be aware that no security measures are perfect or impenetrable.

The safety and security of your information also depends on you.  Where we have given you (or where you have chosen) a password for access to certain parts of our Sites, you are responsible for keeping this password confidential.  We ask you not to share your password with anyone. 

Retention of your personal information

  • We retain your personal information for as long as we need for a legitimate business purpose. The criteria used to determine the retention periods include how long the personal information is needed to provide our products and services;
  • the type of personal information collected; and
  • whether we are subject to a legal, contractual or similar obligation to retain the personal information.

Children's information

Our Site is not directed to children under the age of 13, and our Terms and Conditions prohibit children under 13 from using our Site. We do not knowingly collect any information from children under 13. If we become aware that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information from our servers. 

Changes to this Policy

Helium has the discretion to update this Policy at any time. If we make any material change to this Policy we will notify you by means of a prominent notice on the Sites prior to the change becoming effective. We will also post an updated version on our Site. We encourage users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this Policy periodically and become aware of modifications.

International transfers

The Site is hosted by Helium Systems Inc., in the United States of America. Any information you choose to send to the Site or Helium will be transferred to Helium in the U.S., and its service providers who may also be located in the U.S. or elsewhere in countries which are not considered to provide an "adequate" level of privacy. Where you submit personal information to us, you consent to the transfer of this personal information to the U.S.


Helium does not intend to offer its product or services in any jurisdiction where the offering of such products or services would be contrary to applicable local law, and any such offer of products or services is void if illegal under applicable law.
